A 35 -year -old man, Oluwafemi Sunday was yesterday arraigned in a magistrate court sitting at Oke-Eda Akure for unlawfully had carnal knowledge of a 9-year-old girl.
The accused person who was brought before Magistrate Ruth Olumilua was said to have committed the offence of rape on November 24, 2019, at joy, Olope street, Ijoka Akure, in the Akure Magisterial district.
According to the prosecution, his offence was contrary to and punishable under Section 218 of the Criminal Code Cap 37, Volume 1, law of Ondo State of Nigeria 2006.
The prosecutor, inspector Martins Olowofeso, applied for the remand of the accused person in prison custody pending the issuance of a legal advice from the office of the Director of Public Prosecution, DPP.
The Defence Counsel, Messr John Adewole, opposed the application of the Prosecutor, and prayed to grant him bail in most liberal term, and promised to produce a reliable and substantial surety.
In her ruling, Olumilua noted that there is no probable cost to remand the defendant in prison, and therefore granted the defendant bail in the sum of N500, 000 with two sureties in like sum.
She ruled that one of the sureties must be a close relative and the other one must be a credible person.
She also ordered that the case file be forwarded to the office of the Public Prosecution for legal advice, and adjourned the case till December 30, 2019.
